The purpose of this Privacy Policy (“Privacy Policy”) is to demonstrate the commitment of the Dietbird tool (“Application” or “Web Platform”), owned by NUTEC PARROT LTDA – ME. (hereinafter “Nutec Parrot”), legal entity under private law, registered with the CNPJ/MF under nº 45.856.404/0001-10, with headquarters at Av. 02, SN, Bairro Santos Sátiro, in the city Maracanaú, State of Ceará , Brazil, CEP 61919-000, with privacy and protection during the processing of the personal data of its users (“You”), establishing the rules on the collection, registration, storage, use, sharing, classification and elimination of data processed within the scope of the Platform’s services and functionalities, in all IT media on which it operates.

1. Consent
By selecting the checkbox corresponding to the option “I have read and agree with the Privacy Policy”, you declare:
Be over 18 (eighteen) years of age and/or capable of personally performing the acts of civil life, in accordance with the Civil Code (Law nº 10,406/2002);
That you have read carefully and agree with the provisions, expressing your free, express and informed consent for Dietbird to process the data as provided herein;
You are aware that the exclusion or revocation of consent to the processing of essential information for managing your account will result in the termination of your registration, with consequent cancellation of the services then provided, making it impossible to use the Platform.

If you are under 18 (eighteen) years of age and/or incapable of personally carrying out the acts of civil life, it is the duty of your parents and/or guardians to express, together with you, specific consent to the processing of personal data provided for in this Policy of Privacy.
To verify the consent expressed as above, we will request the email address of the indicated parent and/or guardian, to whom a form confirming responsibility will be sent.
2. What data do we collect?

The collection of user data is essential for the operation of the Platform. Using the data collected, we can offer, develop and improve tools when delivering Dietbird services. Considering that our data collection occurs in several different situations, depending on your form of interaction with the Platform, to make it easier for you to understand how we collect data, see below the groups that correspond to the different forms of interaction with the Platform.
A) Data collected from users:
We understand web users to be two specific segments of data subjects, which are: (i) people who seek to download the application from application stores; and (ii) people seeking to access the Dietbird Platform via the web.
Data collected during registration: we store and process all data entered by users when they register on the Web Platform or Application. This registration data allows us to identify the user and grant access to areas reserved for subscribers or non-subscribers of the Platform.The data that we require when registering are: your full name, email and the creation of a password. In addition to these, all data voluntarily entered by the user throughout their use of the Platform are processed.
B) Data entered for specific activity on the sales website:
Data collected to access the free class: so that you can access the free content available on the Dietbird sales website, we collect the following data: your full name and your email. When collecting this data, we ask for your consent to send news from the Platform to your registered email address, as well as proportional information and other content related to the service provided. If you express consent and wish to revoke it later, all of these emails sent have an opt-out option or another form of express expression that you are no longer interested in receiving our content by email, you can contact Contact us via the following email: dietbird1@gmail.com.
C) Data entered for specific activity on the Application and Web Platform:
Data collected to access the content of the Application or Web Platform: so that you can access our content available on the Dietbird Pro Application or Dietbird Pet Web Platform, we collect the following data: full name, email address mail and creating a password. When collecting this data, we ask for your consent to send news from the Platform to your registered email address, as well as proportional information and other content related to the service provided. Payment details: regardless of the plan (Premium or Evaluation) that you have registered, we treat your payment details in the same way, debiting the charge corresponding to the chosen plan annually on the indicated credit card. For this function, we use Stripe and/or the app stores’ own payment gateways. The data collected for payments are: credit or debit card number, cardholder’s name, cardholder’s CPF, expiration date and security code.
Billing data: so that we can comply with our tax obligations, we necessarily collect some of your billing data such as: name, CPF, address, city, zip code and country.
Data collected automatically: In addition to the data above, we collect, through cookies and other navigation technologies, a set of data that informs us how, when and from what location you use the Platform, in addition to other information of traffic. We also collect data such as the browser used to access Dietbird on the web, the language you use, the operating system of your device, your IP address, among others. It is very important that you know that collecting this type of data is essential for our IT team, especially when you need some support. When we have this data about your navigation through the Platform, we can more quickly offer a solution to any problem you may have while using Dietbird.Furthermore, without this information, we would not be able to guarantee the regular functioning of the Platform and its maintenance. 3. For what purpose do we process your data?
All data we collect is directly related to the proper functioning of the Platform, in addition to making periodic improvements and user support services. Below we list the purposes, in accordance with the LGPD (General Data Protection Law, 13,709/18), which guide the processing of your personal data by Dietbird.
Provision of our service: The vast majority of data we collect is used to provide our services in the most efficient way possible, regardless of who the beneficiary of these services is and the format of the Platform (web or app) .
Maintenance and improvement of services: we are constantly monitoring Platform user traffic. This allows us to determine which Dietbird features and tools are most useful to you and how we can deliver an increasingly better user experience. Furthermore, we use non-anonymous data that we hold to provide support services in addition to support in exercising your rights as a data subject, as set out in item XXX of this Privacy Policy.
Customer support: another essential factor in the quality of our service is providing users with efficient solutions to any problems in their experience with the Platform brought to our attention. To do this, in support calls we may use the personal data necessary for contact and resolution of the issue, such as: your full name, email, cell phone number or address, among others. For the same purpose of optimizing your user experience, we may collect statistics on the use of the Platform.
Billing: It is essential for us to maintain our legal and fiscal regularity that we process your billing data. Therefore, and exclusively for this purpose, we collect, upon payment, the personal data already listed above.
Legal issues: Exceptionally, we may use your personal data to comply with judicial and administrative orders, in addition to tax inspections and regularity regarding the processing of personal data, in addition to other hypotheses provided for by law. Therefore, in accordance with the LGPD, in situations of need to comply with an obligation or exercise a right, the personal data we process may be made available to the administrative, judicial or judicial authority, when our legal department deems it legitimate, in which case all measures will be taken. the appropriate, authorized and reasonably expected measures to restrict the disclosure of this data
Marketing: another situation in which we will use your personal data includes the work of our marketing team, by sending emails, notifications, text messages, among others. Marketing actions will always depend on your express authorization, and your right to freely choose not to authorize and/or cease this action will always be guaranteed. To provide a personalized user experience, the processing of these communications may be subject to automated individual decisions, including profiling.
Security and contractual purposes: your personal data may also be subject to analysis in situations that indicate suspicious or fraudulent conduct, so that we can ensure that contractual relationships between Dietbird and users are promptly fulfilled .
4. How we store your data.
Your data will be collected by the Platform, as indicated in the previous items, and will be stored securely through the partner company Railway, which provides security in accordance with the highest standards worldwide. More information can be found at railway.com.
In accordance with what is authorized by the LGPD, your personal data may be kept by Dietbird for different periods of time, depending on its legal relevance or the duration of the contractual relationship with the user. As a rule, when you exercise your right to request the deletion of your personal data from our storage banks, we will anonymize them1 and maintain them exclusively for the time necessary to comply with our legal duties. Once the legal obligation has been fulfilled, your anonymized personal data will be permanently deleted from all servers. /// If you decide to exercise your right to request the deletion of your personal data from our storage banks, it is likely that we will not be able to respond to your request immediately, given that Dietbird’s compliance with some legally stipulated duties depends on the availability of this data. As for other data collected by Dietbird, it will only be kept on our servers as long as necessary for your use of the Platform, or until: (i) the purpose has been achieved or; (ii) the data is no longer necessary or relevant to achieving the specific purpose sought or; (iii) you have communicated the revocation of permission to process the data (except when considering the provisions above); (iv) the data processing period has come to an end or;(v) until Dietbird’s legal or regulatory obligations have been fulfilled
5. How we share your data.
To provide the services included in the Dietbird Platform, we use several tools developed internally, in addition to our own employees. However, to optimize your user experience, we also use contracts with partner companies, in addition to products provided by external organizations, identified below. The way in which each of these external organizations relates to the processing of your personal data by Dietbird is set out below.
Contracted third parties: as described above, your personal data may be shared with third-party companies (such as press relations and accounting), to select and produce advertisements consistent with your profile, as authorized and maintain the website in operation

(b) Microsoft (Teams, Azure and Onedrive): We use Microsoft tools in our daily lives within Dietbird, for communication between teams, task management and other activities related to the operation of the company. (c) RD Station:The RD Station platform is mainly used by Dietbird’s marketing area to create forms used in campaigns and promotional materials. Within the tool, our team has access exclusively to quantitative, macro and non-identifiable information. (d) Asana: Asana is also a platform aimed at managing Dietbird, into which we enter internal data. For more information about how Asana handles your data, see: https://asana.com/en/terms.
(e) MLabs: Another tool used by the Dietbird marketing team, MLabs is a platform for managing and unifying communication on social networks. Through Mlabs we were able to filter all Dietbird accounts and profiles and centralize their control in a single tool. 6. Your rights as a holder of personal data (user).
Regardless of the nature of your relationship with Dietbird, the processing of your personal data is to ensure that your rights are fully respected. In situations where the automatic mechanisms already implemented are not sufficient to fully ensure the satisfaction of these rights, you can contact us by email at dietbird1@gmail.com.

(i) Confirmation of the existence of processing: Right to question whether the Platform is collecting, receiving, classifying, using, reproducing, transmitting, distributing, processing, archiving, storing, eliminating, evaluating or modifying any of its data, as well as obtaining clear information about the origin of the data, the lack of registration, the criteria used and the purpose of the processing;
(ii) Access to data: Right to access your collected data and its content;
(iii) Correction of incomplete, inaccurate or outdated data: Right to request rectification if your data is incomplete, inaccurate or outdated;
(iv) Anonymization, blocking or deletion of unnecessary, excessive or processed data that does not comply with the provisions of the law:Right to unlink your personal data from your person, temporarily suspend processing or exclude any data from storage .
(v) Data portability:Right to request portability from another service or product provider, in accordance with regulations and observing any commercial and industrial secrets of Dietbird and its partners;
(vi) Deletion: Right to request that Dietbird delete data previously collected with your consent;
(vii) Information about sharing: Right to question any public and private entities with which Dietbird shared data use;
(viii) Explanation of consent: Right to be informed about the possibility of denying consent, as well as the consequences of denial;
(ix) Opposition: Right to object to the illegal processing of your personal data;
(x) Automated decision review: Right to obtain information and review the criteria used in any automated data analysis with a view to defining a consumption profile, personal and professional profile and other aspects of your personality.
(xi) Revocation of consent: Right to revoke, by express statement, the authorization given to the Organization for the processing of any data.
Attention! You can request the deletion of your personal data processed and collected by Dietbird with your consent via email dietbird1@gmail.com or via request to cancel your Dietbird account, we will have a period of 180 days to carry out this action. Dietbird will only retain the personal data necessary (i) to comply with a legal or regulatory obligation, (ii) for the purposes of regularly exercising rights in judicial, administrative or arbitration proceedings; (iii) when necessary for contract execution; (iv) in an anonymized format, as per art. 7th of the LGPD.
7. International data transfer
Furthermore, your information processed by Dietbird may be transferred, stored and processed by Dietbird outside the country in which you reside, considering the availability of the service outside Brazilian territory and the hiring of third parties located on foreign soil, such as the storage used by Dietbird on the servers of the companies Railway and Microsoft, as informed in items 4 and 5. Therefore, if transferred, your data will be treated for the same purposes that justify its collection at a national level.
Dietbird will take all legally required and technologically necessary measures so that your personal data is protected in an equivalent way in the foreign jurisdiction, respecting the provisions of the LGPD that international transfers will only be made to countries orinternational organizations that provide a level of protection for personal data appropriate to that provided for in the LGPD itself (Art. 33, item I). By accepting this form of processing, you accept that your data will be transferred, stored or processed by Dietbird outside the country in which you reside.
8. Security measures.
The security of your data and the services we provide is one of our highest priorities. Therefore, we regularly analyze the Platform and our servers to ensure that all legally required and technologically necessary measures are taken to mitigate risks regarding security incidents, using the most current encryption, surveillance and auditing techniques. These measures may only be reflected on our servers or have an immediate impact on your user experience on the Platform, as is the case with requiring greater complexity in passwords, new SSL certificates, two-factor verification, among others.
9. Privacy policy of other applications or websites.
Our Platform contains links that may direct you to other applications or websites. However, this Privacy Policy only applies to Dietbird tools, so if you are directed to other applications or websites, you must observe their respective privacy policies.
10. Changes to our privacy policy.
You will be notified using the contact information provided in your registration regarding any changes to our Privacy Policy through an informative email sent to all users registered in the Dietbird database.

12. Legislation and Venue

12. Legislation and Venue
Any doubts, questions and disputes arising from this Privacy Policy will be resolved in the Court of the District where the Platform is domiciled, to the exclusion of any other.
